With the exponential growth of Ai in the world today, Ai regulation in India is becoming a key topic of discussion. Our Partner, Nikhil Narendran, explores this evolving landscape, emphasising the need for a balanced generative Ai regime in India – one that fosters innovation while ensuring robust Ai risk mitigation.
He highlights how existing laws, such as the Information Technology Act and the Digital Personal Data Protection Act, already address many risks posed by Ai, and flags the need for stronger enforcement mechanisms to tackle the amplification of existing harms that could arise because of Gen Ai.
Nikhil goes on to discuss the importance of considering new approaches to our traditional liability and intellectual property (IP) regimes in the context of Gen Ai. For example, a safe harbour protection for generative Ai based on a duty of care for Ai developers could be considered, as could incorporating fair dealing exceptions in IP laws to facilitate more training of LLMs on Indian data.
