Overview
Abhishek Kumar is a Partner in the Dispute Resolution Practice at Trilegal’s Delhi office. He specialises in complex regulatory, commercial, and energy sector disputes, with extensive experience in developing and executing dispute resolution strategies.
He has successfully represented leading power sector companies, government utilities, and multinational corporations before the Supreme Court of India, High Courts, APTEL, CERC, and other regulatory forums, handling several landmark matters in the energy and infrastructure sectors and is recognised for his strategic approach to complex litigation and regulatory challenges.
Among his notable matters, Abhishek has spearheaded Supreme Court litigation on behalf of Bihar’s distribution licensees on the deemed licensee status of Indian Railways under the Electricity Act, 2003, and has successfully represented clients in high-stakes tax challenges before the Uttarakhand and Himachal Pradesh High Courts concerning hydropower generation.
He has also secured significant wins before APTEL, including upholding UPERC’s application of the defaulter’s liability principle as laid down by the Supreme Court in Power Grid Corporation of India Limited v. Punjab State Power Corporation Limited (2016) 4 SCC 797, and successfully vacating a UPERC order directing UPPCL and UP DISCOMs to deposit INR 7,244.65 crores into an RPO compliance fund.
Beyond the power sector, Abhishek has advised Coinbase in pursuing criminal action against former employees involved in data theft and breach and has represented AEPL before CERC in a pivotal matter concerning the exercise of CERC’s discretionary powers under the 2022 Connectivity Regulations.
