Overview

Apeksha is a Partner in the Corporate and Labour and Employment practice at Trilegal with 15 years of law firm experience. She advises on all employment-related aspects of corporate contracts and transactions in India, as well as multi-jurisdictional cross-border transactions. With extensive experience in transaction advisory aspects, Apeksha regularly advises clients looking to set up businesses in India on employment and labour compliances, employment aspects of all commercial transactions, including analysis and due diligence, mergers and acquisitions, disposals, private equity investments, takeovers and restructurings, along with issues around employee transfers, service provision changes, establishment of new plans, and post-closing integration and implementation.

Apeksha has in-depth knowledge and extensive experience covering all legal aspects of the employment and labour practice and has advised clients on complex employment law issues pertaining to workforce structuring, contentious senior management exits, reductions in labour force, closures, employee transfers, integrations, workplace harassment, enforceability of non-competes and other restrictive covenants, trade unions, implications for and liabilities of directors and principal officers under various statutory labour enactments, compensation structuring, designing, and reviewing incentive schemes for various grades of employees, employee benefits funds and stock option schemes.

She also advises on immigration issues, criteria for grant of visas (business, employment, etc.), immigration rules applicable to expatriates, and coordination with immigration agents on Foreigner Regional Registration Office (FRRO) registration and protocols. She regularly assists with employment audits and investigations, employee frauds, mismanagement, breach, and sale of confidential data by employees, investigating charges, conducting interviews, preparing scripts for management discussions with the suspect/implicated employees, and corrective steps for system cleansing.

Additionally, she conducts training sessions sensitising HR teams and senior management to anti-harassment and anti-discrimination laws, and appropriate complaint redressal in case of discrimination and harassment.
