Trilegal successfully represented TPG Software before the Delhi High Court in a critical transfer pricing appeal relating to the selection of comparable companies for transfer pricing analysis in the case of a captive software development service provider.
High Court allowed TPG’s appeal and intervened in an issue involving selection of comparables for transfer pricing analysis, holding that the Income-tax Appellate Tribunal’s order was perverse due to its failure to provide reasoned findings on selection of comparables.
This ruling is a crucial development in tax litigation which ensures a remedy before High Courts on questions of facts in case of perverse findings and unreasoned orders.
