Jitendra Motwani on GST Council reforms, ITC disputes and compliance simplification – Trilegal

This is a link enhanced version of the article that first appeared in CNBC-TV18.

Article Overview:
The article explores expectations from the 57th GST Council meeting, focusing on key reforms around decriminalisation, ITC disputes, arrest powers and compliance simplification. It highlights industry expectations for greater certainty for taxpayers through a more balanced enforcement framework, clarity on input tax credit-related issues and measures aimed at improving ease of doing business.

Our Partner, Jitendra Motwani, shared his perspective. Here’s what he had to say:

“Businesses would be keenly watching proposals around decriminalisation, ITC disputes and compliance simplification. He said keeping routine ITC and classification disputes outside the criminal framework, along with judicial oversight of arrests, could provide greater certainty to taxpayers.

Proposals concerning ITC on employee group insurance and outdoor catering, as well as provisions that could allow genuine recipients to retain credit where a supplier defaults. However, he said the extent of relief would ultimately depend on the implementation of the decisions through subsequent circulars and field-level action.”
