Trilegal successfully represented Education Today (a part of the India Today Group) before the Hon’ble Delhi High Court in a trademark action to secure its intellectual property rights in its registered mark “Vasant Valley”. The Hon’ble High Court secured Education Today’s rights in the trademark and decreed the Suit in terms of a Settlement Agreement dated 12 May 2026 entered between Education Today and the Vasant Valley Concept School, Telangana. As a part of the decree, the Vasant Valley Concept School, Telangana, was caused to change its name and take down its website, social media handles and advertisements on public platforms using the infringing mark, and albeit undertake to not indulge in any act of infringement, passing off and/or dilution of Education Today’s registered mark – “VASANT VALLEY”.
Matter Overview | Education Today approached Trilegal after having been informed that their trademark may have been infringed by other schools. Trilegal advised Education Today to order an investigation which resulted in the discovery of the acts of infringement of Vasant Valley Concept School, Telangana. This included the unauthorized use of the word mark “VASANT VALLEY” on domain names, websites, social media platforms like Facebook, Instagram and YouTube, advertisement portals like JustDial, goods, merchandise, banners and hoardings put up by the Vasant Valley Concept School in Telangana.
Accordingly, the Trilegal team filed a commercial suit (Suit) before the Hon’ble Delhi High Court seeking permanent injunctive reliefs against Vasant Valley Concept School’s unauthorized use of Education Today’s registered mark – VASANT VALLEY. Education Today was continuously using the registered mark to operate the Vasant Valley School, New Delhi, from 1990. The mark had therefore acquired significant reputation and was well-known for its association with the school run by Education Today in New Delhi. Vasant Valley Concept School was subsequently set up in 2005, from which time it has been using a name which is deceptively similar to Education Today’s prior and registered mark in the education sector.
Trilegal secured results for Education Today in record time. On 05 May 2026, the Suit came up for hearing for the first time before Justice Tushar Rao Gedela of the Hon’ble Delhi High Court. After a perusal of the Suit and basis the submissions made on behalf of Education Today, the Hon’ble Court observed that the Vasant Valley Concept School had been using a trademark which was deceptively similar to Education Today’s registered mark. Pursuant to a proposal from Vasant Valley Concept School, the Hon’ble High Court permitted the parties to amicably discuss and mediate the disputes arising out of Vasant Valley Concept School’s acts of infringement.
Trilegal drew up the terms of settlement within no time and after a round of discussions at our office in New Delhi, the parties executed a Settlement Agreement on 12 May 2026. As a part of the settlement, Vasant Valley Concept School agreed and undertook to change its name and remove Education Today’s registered mark therefrom. Trilegal secured Education Today’s intellectual property rights in its registered mark whereby Vasant Valley Concept School also undertook to not indulge in any act of infringement, passing off and/or dilution of Education Today’s goodwill in the mark – VASANT VALLEY. Vasant Valley Concept School also took down its website and YouTube page and undertook to take down its social media pages on Facebook, Instagram and Just Dial and file an appropriate application before the relevant state authorities to change its name officially. As a gesture of good faith, Education Today did not make a claim for damages.
On 19 May 2026, the Hon’ble High Court decreed the Suit in terms of the Settlement Agreement. As a matter of significance, the Hon’ble High Court passed appropriate directions to Meta Platforms Inc. and Just Dial Limited to ensure compliance with the terms of the Settlement Agreement should Vasant Valley Concept School fail to take down its pages on Facebook and Just Dial.
It is pertinent to note that the Hon’ble High Court directed Vasant Valley Concept School to file a compliance report by 10 July 2026. The disputes arising out of the infringement of Education Today’s mark were resolved in a fortnight.
The matter was argued by Senior Advocates Mr. Rajiv Nayar and Mr. Nakul Dewan, along with the Trilegal disputes team.
Matter Significance | This matter underscores the importance of protecting brand identity and consumer interest in the education sector, where institutional names and trademarks serve as critical indicators of reputation, quality, and trust. The unauthorized adoption of an established mark such as VASANT VALLEY by a third-party educational institution creates a substantial likelihood of confusion and deception among stakeholders at large, including students, parents, educators, and the public, particularly in relation to institutional affiliation, legacy, and educational standards.
Given the significant goodwill and distinctiveness associated with the VASANT VALLEY mark through its continuous use since 1990, deceptive adoption by unrelated entities risks not only trademark dilution and erosion of brand value, but also public injury arising from false association or misrepresentation.
In the context of educational services, where parents and students make critical long-term decisions based on institutional reputation and perceived credibility, safeguarding trademark rights assumes heightened importance. Trilegal successfully protected Education Today’s intellectual property rights and reinforced judicial safeguards against infringement and misrepresentation, including across digital platforms and online business listing portals.
