Trilegal acted as the international legal counsel to the resolution professional (Mr. Gajesh Labhchand Jain (“RP”)) of Compuage Infocom Limited (“Company”) to advise and strategize on getting the RP and the Company recognition in Singapore under the UNCITRAL Model Law on Cross-Border Insolvency as adopted in Singapore (“SG Model Law”).
Oon & Bazul LLP was appointed as the local counsel in Singapore by the RP for representation before the Hon’ble Singapore High Court (“SHC”). Trilegal along with the local counsel drafted and finalised the application (“Recognition Application”) filed before the SHC for recognition of the Company’s corporate insolvency resolution process initiated in India. Trilegal also instructed the local counsel during the course of hearing before the Hon’ble SHC on queries posed by the SHC in relation to the Company’s Indian insolvency resolution process and the Insolvency and Bankruptcy Code, 2016 (“IBC”).
The Hon’ble SHC through its judgment on the Recognition Application granted recognition of the corporate insolvency resolution process of the Company, as a foreign main proceeding within the meaning of Article 2(f) of the SG Model Law.
The Hon’ble SHC also granted recognition to the RP as a foreign representative within the meaning of Article 2(i) of the SG Model Law. Pursuant to the Hon’ble SHC’s Ground of Decision dated 24th March 2025, the RP has been granted the power to take all actions reasonably necessary
The judgment is a landmark judgment as it marks one of the first instances where international recognition has been granted to an Indian corporate insolvency resolution process and a resolution professional.
