Trilegal successfully represented Big Tree Entertainment Private Limited (“Client”) in an Appeal before the State Consumer Disputes Redressal Commission (“State Commission“) at Vijayawada.
The appeal was preferred challenging an order of District Consumer Forum (“District Commission“) whereby the District Commission concluded that the ticket selling services provided on Client’s platform “bookmyshow” are deficient in nature. The Complainant challenged the validity of the platform fee charged by the Client. The State Commission set aside the order stating that the business model of the Client provides transparency, charges fee for convenience provided to customers and does not amount to deficient service.
The judgment of the State Commission is of great importance as it acknowledges the validity of the convenience fee charged by the Client which is a welcome move for the intermediary platforms across the country as it is in effect an acknowledgment of the validity of similar business models. Further, it also harps on the principals of natural justice and highlights the importance of application of judicial mind before passing final remarks in a matter.
